GOVERNOR'S EXECUTIVE ORDER PERTAINING TO THE
ESTABLISHMENT OF A PESTICIDE REVIEW BOARD

PREAMBLE

The protection and improvement of the present and future environmental quality of this state is a matter of the utmost public concern. The legislature has found and declared that the unrestricted use of various pesticides may or will so adversely affect the environmental quality of this.state as to endanger the health and welfare of the public.

In pursuit of this state's basic policy of protecting and improving its environmental quality and pursuant to the executive authority vested in the Governor by the Constitution of this state, I hereby proclaim the following executive order:

ARTICLE I -- Formation of a Pesticide Review Board

The Washington Pesticide Review Board is hereby created, consisting of the Dean of the College of Agriculture at Washington State University; the Director of the State Department of Health and the Director of the State Department of Game:

ARTICLE 11 -- Duties of the Pesticide Review Board

(1) When any pesticide has been declared a restricted use pesticide under the Washington Pesticide Act (Chapter 15.57 RCW) and the Washington Pesticide Application Act (Chapter 17.21 RCW) and the Director of Agriculture has issued an order limiting the Pesticide to essential uses, the Pesticide Review Board shall make a determination within 180 days of those essential uses for the guidance of the Director of Agriculture in accepting or rejecting registrations of the pesticide. In making its determination of essential uses of any pesticide, the Review Board shall consider the need for control of the target pest, whether effective alternate materials are available,,whether the use of such materials is practical, and whether the use of such materials is less hazardous to the environment and/or public health and welfare.

(2) The Pesticide Review Board shall make an annual review of all determinations of essential uses and shall advise the Director of Agriculture of the review findings by December I of each year.
